📋 OVERVIEW & MEMBERSHIP OPTIONS
These plain English terms govern your court benefits, booking privileges, payment structures, cancellation rights, and legal rights. Play More memberships are available as either a monthly membership or an annual membership. Tennis and Pickleball involve physical exertion and risks detailed in Section 8.

Court Benefits First eligible off-peak hour complimentary once per eligible weekday; second immediately consecutive off-peak hour at 50% off; eligible weekday peak hours at 15% off.
Booking Window Access to court reservations 14 days in advance. A maximum of two active complimentary slots are permitted at one time.
Cancellations Complimentary bookings require at least 4 hours notice. Paid court bookings require at least 24 hours notice. Membership cancellations are subject to the rules in Section 3.

1. Contract Framework & Eligibility

The membership agreement is structured directly between the Player and OFRC Trading Pty Ltd (trading as Oxford Falls Racquet Club).

In the event of any inconsistency between documents, priority applies in this order: (1) the Membership Confirmation, (2) these Terms, (3) current online product pages, and (4) OFRC policies.

The purchaser must be 18 years of age or older. A parent or legal guardian may purchase for a minor and accepts operational and financial responsibility for the account.

Memberships are personal to the registered Player and are strictly non-transferable, non-shareable, and cannot be resold.

2. Sport Allocations & Facility Exclusions

Play More Tennis benefits apply exclusively to OFRC-operated Tennis courts. Play More Pickle benefits apply exclusively to OFRC-operated Pickleball courts.

Cross-sport participation is permitted for open social club activities, but complimentary court hire does not cross over unless separate contracts are held.

Padel tennis, Beach Tennis, specialised wellness amenities, and partner-operated or independent commercial services are explicitly excluded from these membership frameworks.

3. Cooling-Off & Membership Cancellation Rules

A 5-business-day cooling-off window applies from the date of sign-up. If no benefits have been used, a full refund will be processed. If court bookings have been used, the standard published public value of those bookings will be deducted from the refund amount.

Monthly memberships are month-to-month and may be cancelled at any time by providing advance written notice to OFRC before the next billing date.

If a monthly membership is cancelled, the membership will remain active until the end of the current paid billing period. No partial refunds or credits apply for unused days within a billing period, except where required by law.

Annual memberships are paid upfront and remain active for 12 months from the membership commencement date. Annual membership fees are non-refundable for change of mind, non-use, scheduling conflicts, or failure to use membership benefits, except where required under Australian Consumer Law or where OFRC agrees otherwise in writing.

Nothing in this section limits any cancellation, refund, or other rights available to a member under the Australian Consumer Law.

4. Payments, Fees & Renewal

Monthly membership fees are processed automatically in advance at the applicable monthly rate. The membership will continue on a month-to-month basis unless cancelled in accordance with
Section 3.

Annual membership fees are paid upfront for the applicable 12-month membership period.

The applicable membership fee will be confirmed at the time of purchase. OFRC may change its standard membership pricing for new or renewing members by providing reasonable notice. Any change to pricing will not retrospectively alter a membership period that has already been paid for.

Monthly memberships do not automatically convert into annual memberships.

Annual memberships do not automatically renew into another annual term unless the member expressly agrees to the applicable renewal arrangement.

If a monthly payment fails, OFRC may provide a reasonable period for the member to update their payment details. Access to membership benefits may be suspended while an outstanding payment remains unpaid.

5. Off-Peak Court Hire & Guest Policies

To access the complimentary off-peak window (Monday–Friday, 7:00am–3:00pm), the primary account holder must make the booking, play on the court, and remain present for the entire session.

Every player participating on the reserved court must hold a current Play More membership for that designated sport for the hour to remain complimentary.

Guest Policy: If any player on the court does not hold the relevant membership, the complimentary hour is automatically waived. The court booking is instead charged at 50% off standard public pricing, payable in advance.

A second consecutive off-peak hour can be reserved at a flat 50% discount. Splitting across the 3:00pm boundary will result in pro-rata pricing for the peak portion. Weekend and public-holiday bookings are at published public rates; the 14-day booking window still applies.

6. Wet Weather & Operational Venue Closures

OFRC facility management holds sole authority to close courts due to persistent rain, severe lightning hazards, extreme heat advisories, or necessary safety maintenance. Local forecasts do not qualify for automatic cancellation.

If courts are officially closed prior to play, the booking slot is automatically released without penalty, and paid segments are fully credited, rescheduled, or refunded.

If dangerous weather conditions interrupt an active session mid-way, staff will calculate a fair, proportional facility credit based on the remaining unplayable minutes.

7. Program Perks & Member Activity Schedule

Members receive a 10% discount on eligible OFRC-run coaching programs, clinics, leagues, competitions and events, together with a 10% discount on eligible café food and non-alcoholic beverages (Perks).

Perks do not apply to retail products, alcohol purchases, private one-on-one coaching, corporate event packages, holiday camps, or already-discounted products.

The Member Activity Calendar may change seasonally based on community demand and operational capacity. Schedule changes do not alter or invalidate the core court-hire pricing guarantees.

8. Statutory Risk Warnings & Liability Exclusions

⚠️ CIVIL LIABILITY ACT 2002 (NSW): In accordance with Section 5M, players are formally warned that participating in Tennis, Pickleball, coaching streams, and social matchplay involves physical exertion and inherent risks. Inherent dangers include slips, trips, falls, sudden direction changes, collision with court fixtures/nets/fences, being struck by high-velocity balls/racquets/paddles, environmental heat stress, and equipment malfunction. Potential medical outcomes span from severe bruising and sprains to concussions, permanent physical impairment, or death. Players enter the venue voluntarily and accept these standard inherent playing risks. Players waive their rights to sue OFRC for any liability that results from a breach of an express or implied warranty that any services will be rendered with reasonable care and skill as permitted under section 5N of the Civil Liability Act.

🚨 COMPETITION AND CONSUMER ACT 2010 (CTH): Under Section 139A, contractual warranties and statutory consumer guarantees regarding due care and skill for recreational services are excluded, restricted, and modified. OFRC excludes all legal liability for death, physical trauma, mental injury, or disease arising from any failure to meet statutory consumer guarantees. This exclusion is void only in cases of significant personal injury resulting directly from reckless conduct by OFRC management as defined under Section 139A(5).

9. Property Loss, Venue Damage & Guest Conduct

Players and external guests are entirely responsible for their own personal belongings. OFRC accepts zero liability for the theft, misplacement, or damage of personal items on venue grounds, except where explicitly mandated by consumer law.

If a member or their invited guest causes intentional, reckless, or grossly negligent physical damage to courts, nets, café assets, or structural hardware, the booking member is legally liable for the full commercial cost of professional repair or replacement.

10. Formal Complaints & Escalation Paths

All official correspondence, billing concerns, or complaints must be formally directed via email to [info@ofrclub.au](mailto:info@ofrclub.au), via telephone at 0412 070 121, or delivered in person to 1110 Oxford Falls Road, Frenchs Forest NSW 2100.

OFRC commits to acknowledging incoming complaints within 5 business days and delivering a formal, substantive written resolution proposal within 10 business days.

If an internal dispute cannot be settled in good faith, members retain full rights to escalate grievances to statutory oversight bodies including NSW Fair Trading, the ACCC, the Office of the Australian Information Commissioner (OAIC), or the NSW Civil and Administrative Tribunal (NCAT).

11. General Statutory Legal Provisions

AUSTRALIAN CONSUMER LAW: Nothing within these terms operates to exclude, restrict, or modify any statutory consumer guarantees, remedies, or legal protections fundamentally embedded under the ACL.

SEVERABILITY: If any specific paragraph, clause, or sub-provision within this agreement is ruled unlawful or legally unenforceable by a competent court of law, that individual element will be cleanly severed. All remaining clauses will continue to operate with full force and legal effect.

GOVERNING LAW: This contract is executed, governed, and interpreted strictly under the laws of New South Wales (NSW), and all parties submit entirely to the non-exclusive jurisdiction of NSW courts and tribunals.
